Moses & Singer's healthcare
practice group has extensive experience in dealing with
issues under federal, state, and local privacy laws. Over the
course of the past few years, Moses & Singer's healthcare
practice group has closely monitored and commented on the development
of the HIPAA administrative simplification rules, particularly
the privacy rule, and has spoken and published articles on HIPAA-related
topics nationwide. Our healthcare clients represent a range
of healthcare facilities, including health plans, academic medical
institutions and large provider entities. We offer our clients
a full range of legal assistance in implementing the HIPAA privacy
rule, including HIPAA privacy risk assessments/gap analyses,
review of contractual and other documents, and incorporation
of operational changes necessary for compliance with the HIPAA
privacy rule's requirements.
In order to address the HIPAA privacy rule's requirement that
the majority of healthcare entities covered by the rule implement
its provisions by April 2003, we have prepared HIPAA Simplification
Tools, a collection of HIPAA policies, forms and business associate
agreements to be used by (1) hospitals or other providers, (2)
health plans, and (3) employers. We have prepared three sets to
be used either alone or in combination by each of these entities
(for example, providers and health plans may wish to also purchase
the employer set in order to implement the rule's requirements
regarding protected health information of their employees who are
provided with health insurance benefits. Each set contains approximately
60 HIPAA policies and forms. HIPAA Simplification
Tools are intended to be used as templates, and all will require
some customization by an attorney. Moses & Singer would
be happy to provide legal assistance in customizing these policies
and forms.
